In the event that Gramercy Auctions LLC determines that I have made the Successful Bid and declares that I am the Successful Bidder, I expressly acknowledge and agree to the following Terms and Conditions:

  1. I have read, signed, and agree to be bound by, the Terms and Conditions of Participation for the Auction Sale of the above Property;
  2. Immediately upon the conclusion of the bidding for the Property (i) I will execute the Memorandum of Sale and provide the Deposit; and (ii) I will submit the Qualifying Deposit in the amount of $ (dollars) to Gramercy Auctions LLC unless I have previously done so; The Qualifying Deposit will be made payable to myself, and endorsed to the Escrowee. NO EXCEPTIONS PLEASE!
  3. I will provide Gramercy Auctions LLC with the Deposit for the Property in accordance with the Terms and Conditions of Participation;
  4. Prior to attending the Auction for the above Property, I conducted my own independent investigation in accordance with the Terms and Conditions of Participation, and relied upon same in connection with my bid for the Property;
  5. A Buyer’s Premium of 5% (five percent) of the Successful Bid will be added to the Successful Bid, and incorporated into the Purchase Price for the Property and be paid at the Closing;
  6. The Property is being sold “as is” without any warranties of any kind, express or implied;
  7. The sale of the Property is subject to seller’s confirmation and acceptance;
  8. For the balance of the Deposit I will provide a check which must clear immediately after the Auction Sale;
  9. If any check given in payment is not honored for any reason, whether said check has been signed by me as maker or endorser, and if such check is placed into collection, I agree to pay all reasonable attorney’s fees and other costs in connection with such collection efforts;
  10. I expressly provide authorization to Gramercy Auctions LLC to verify and review the current status of my credit report and to use such information to determine my financial ability to purchase the Property;
